These Terms of Service ("Terms") govern your use of the Elvietra website (elvietra.com) and any commission, purchase, or communication with Elvietra ("we," "us," "our"). By placing a commission, making a purchase, or using our website, you agree to these Terms. Please read them carefully.

01Who We Are

Elvietra is a bespoke portrait house creating digital fine art portraits, finished on gallery-grade archival canvas, commissioned from customers' own photographs. We also offer premium corporate gifting through Elvietra Privé.

02Commissions

Each commission is a bespoke, made-to-order artwork created from photographs and information you provide. By submitting a commission request, you confirm that:

• You own the rights to, or have permission to use, every photograph you submit.
• You have the consent of any identifiable person appearing in the photographs (or the legal authority to provide such consent on their behalf, such as a parent for a child).
• The information and photographs you provide are accurate and belong to you.

We reserve the right to decline any commission request, including but not limited to requests involving photographs we cannot verify, content that infringes on the rights of others, or subject matter we are not able to create.

03Pricing & Payment

Prices for each commission tier are listed on our Investment page and are subject to change without notice for future commissions. A deposit is required to begin your commission and secure your place in our schedule, with the balance due before delivery, as outlined during your consultation. All prices are listed in Indian Rupees (INR) unless otherwise agreed for international or corporate orders.

04Revisions & Approval

Each commission includes a set number of preview and revision rounds, as specified for your chosen tier. Once you approve the final preview, the piece proceeds to production and can no longer be altered, except in the case of a manufacturing defect. 05Delivery

Estimated timelines are provided at the time of consultation and vary by tier and complexity. Timelines are estimates, not guarantees, and may be affected by factors outside our control, including courier delays. We are not responsible for delays caused by incomplete, low-resolution, or late-provided photographs or information from the customer.

06Intellectual Property

Once a commission is paid in full and delivered, you own the physical artwork for personal display and use. Elvietra retains the right to photograph, reproduce, and share images of the finished piece for our own portfolio, marketing, and social media, unless you request otherwise in writing before delivery (for example, for privacy reasons relating to a memorial commission).

The techniques, styles, and creative process used by Elvietra remain our intellectual property. Commissioning a piece does not grant you rights to reproduce, resell, or commercially exploit the artwork or our creative process without our written permission.

07Ready-Made Editions

Where Elvietra offers finished, ready-made pieces for direct purchase (rather than bespoke commissions), these are sold as described on their individual product listings, including edition status (one-of-one or numbered edition) where applicable.

08Elvietra Privé (Corporate Orders)

Corporate, bulk, and gifting-programme orders placed through Elvietra Privé are additionally governed by the terms set out in your individual proposal or agreement, which take precedence over these Terms where they differ.

09Limitation of Liability

Elvietra is not liable for indirect, incidental, or consequential damages arising from the use of our website or the commissioning process, beyond the value of the commission itself. Nothing in these Terms limits any liability that cannot be excluded under applicable law.

10Website Use

All content on this website, including text, images, logos, and design, is the property of Elvietra and may not be reproduced or used without permission. You agree not to misuse the website, attempt unauthorised access, or use it for any unlawful purpose.

11Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date above will reflect the most recent revision.

12Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Elvietra's services will be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat.
